Terms of Service
These terms are the agreement between you and Alexandra Vasilyeva for your use of Rally. They're written to be read, not skimmed past — if anything here is unclear, ask before you agree to it.
1. Who these terms are for
Rally is sold to coaches. When these terms say you, they mean the coach or coaching business holding the account. When they say your clients, they mean the players, parents, academies and clubs you record in Rally.
Your clients don't have a contract with us. If you invite them to their own Rally login, they get access to their own schedule and balance, but the relationship — the coaching, the fees, the cancellations — is between you and them.
You must be at least 18 and able to enter into a contract to hold an account.
Rally is offered for business use only. By creating an account you confirm you're acting as a business (Unternehmer) and not as a consumer.
That's not a formality — it's the basis on which the rest of this document is written. Consumer contract rules, including the 14-day right of withdrawal for distance contracts, don't apply between businesses. If you're not coaching commercially, Rally isn't sold to you.
2. What Rally is, and what it isn't
Rally is a record-keeping and scheduling tool. It stores your calendar, your clients, the hours you've coached, what's been paid and what hasn't, and produces reports from that.
Rally is not:
- an accountant, bookkeeper or tax adviser — the totals it shows are a record of what you entered, not a certified account;
- a party to your coaching agreements, or responsible for whether your clients turn up or pay;
- a payment processor for money your clients owe you (see §5);
- a backup service. Keep your own copies of anything you can't afford to lose — Rally can export your data at any time.
3. Your account
Give accurate details and keep your password to yourself. Anything done through your login is treated as done by you, so tell us promptly at rallycoachingapp@gmail.com if you think someone else has access.
One account is for one coaching business. You can invite your clients, but sharing a single coach login between separate businesses isn't permitted.
4. Price
Rally is free while it's in early testing. There is nothing to pay, no card to add and no trial running out.
Every feature is switched on. We may start charging later — if we do, we'll email you at least 30 days beforehand and you can simply stop using Rally, export your data, or delete the account. Nothing will ever be charged to you without you actively agreeing to a price first.
In exchange, understand that Rally is early software. It will have bugs. Keep your own record of anything you can't afford to lose, and please tell us when something breaks — that's the point of the testing period.
5. Money your clients pay you
Payments from your clients go directly to your own Stripe account. They do not pass through Rally, and Rally takes no percentage of them.
If you connect Stripe and turn on client payments, Rally creates the charge on your Stripe account using Stripe Connect. That makes you the merchant of record for those payments. In practice that means you — not us — are responsible for:
- the price you charge and any VAT or sales tax on it;
- invoices and receipts your clients or their accountants ask for;
- refunds, chargebacks and disputes, including Stripe's fees on them;
- your own agreement with Stripe, which is separate from this one.
Most coaches are paid in cash or by bank transfer outside the app entirely. That's expected — Rally lets you mark a session paid or unpaid by hand precisely because most money never goes near it. Marking something paid in Rally is a note to yourself. It doesn't move money and it isn't a receipt.
Cancellation fees work the same way. Rally calculates them from the notice given and records the amount against the client's balance. It does not collect them. Whether a fee is actually enforceable is between you and your client, and depends on what you agreed with them and on consumer law where you are.
6. Acceptable use
Don't use Rally to store or send anything unlawful, to harass anyone, or to hold data you have no right to hold. Don't try to reach other coaches' data, probe the service for weaknesses, or resell access. We can suspend an account that does, and will tell you why.
7. Your clients' data is your responsibility
For the records you enter about your clients, you are the data controller and Rally is your processor. That means the legal duty to those people is yours.
This isn't a technicality. When you type an academy's players into an attendee list, you're recording personal data about people who have probably never heard of Rally — sometimes children. Before you do, make sure you have a proper basis for it, that the academy knows you're keeping the record, and that you're only keeping what you need for the timesheet.
We handle that data only to run the service and only on your instructions. The detail — what we store, for how long, who else touches it — is in the Privacy Policy, which forms part of these terms. 8. Your data stays yours
You own everything you put into Rally. We take no ownership of it. We only use it to provide the service to you, keep it backed up, and fix things when they break — never to sell, never to advertise to your clients, never to train anything.
You can export your academy timesheets to Excel at any time from the Reports page, and request a full copy of your account data at rallycoachingapp@gmail.com. If you delete your account, we delete it — see the Privacy Policy for exactly what goes and what has to be kept.
9. Availability and changes
We work to keep Rally up but don't promise a particular uptime, and there's no service-level agreement on the standard subscription. The service depends on providers like Supabase, Vercel and Stripe, and an outage at one of those is an outage for Rally.
Features will change. We may add, alter or retire them. If we remove something you rely on, we'll give reasonable notice by email, and you're free to cancel.
10. Liability
Rally is provided as it is. To the extent the law allows, we're not liable for lost bookings, lost income, lost data, or a client who didn't pay you — including where a bug, an outage or a mistaken figure in Rally contributed to it.
Where we are liable, our total liability to you for everything arising out of these terms is capped at the subscription fees you paid us in the 12 months before the claim.
Nothing here limits liability for death or personal injury caused by negligence, for intent or gross negligence, for fraud, or for anything else that can't lawfully be limited under Austrian law.
11. Ending the agreement
You can stop at any time by cancelling your subscription and deleting your account from Settings.
We can end it if you break these terms, don't pay, or use Rally in a way that puts other people's data at risk. Except where the breach is serious enough to act immediately, we'll give you 14 days' notice and a chance to put it right.
However it ends, you get at least 30 days from the end date to export your data before it's deleted, unless the account was terminated for unlawful use.
12. Changes to these terms
We'll email you at least 30 days before any change that materially affects you, and the date at the top of this page always shows the current version. Carrying on using Rally after a change takes effect means you accept it; if you'd rather not, cancel before then.
13. Law and disputes
These terms are governed by the law of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Because Rally is sold business-to-business, the exclusive place of jurisdiction is the competent court in Austria.
